KAMPALA - The Commercial Court in Kampala will on Monday (March 13, 2023) deliver a ruling in a case in which the executor of the estate of the late Bulaimu Muwanga Kibirige, popularly known as BMK, is seeking to stop the bank from selling family property.  

Equity Bank Uganda Limited was in the process of selling the property worth sh2b situated in LRV 4571 Folio 5 plot 15 Upper Naguru in Kampala, to recover its debt.

The Commercial Court Deputy Registrar Juliet Harty Hatanga, will deliver the ruling.

Ali Muwanga Kibirige run to the court after his siblings went behind him to mortgage the property without his knowledge.

He sued Haruna Kalule Muwanga, Shadia Nabunya Muwanga, Sophia Bayiga Muwanga (the deceased’s wife), Equity Bank Uganda Limited and the Commissioner Land Registration.

In the application, Ali Muwanga, the executor of the estate of the deceased, seeks an order, restraining the bank from selling and interfering with the property, until the main case is determined.

He swore an affidavit, stating that their father fell ill and was hospitalized at Aga Khan Hospital from March 2020 to September 10, 2021, when he passed away after battling cancer for long.

Ali Muwanga says when his father died, he was granted probate to manage the estate of the deceased.

Isha Baguma, a senior legal officer in the bank, said on January 21, 2022, the bank advanced a credit facility to HRN Business Service Limited, amounting to sh2b, for the construction of 14 maternity units in the regions of West Nile and Lango Sub-region.
